Neighbor cut down tree and hit my house

Our next door neighbor had a tree that was dead, and we asked them to have it taken down before it hits our house. We even gave her estimates from insured tree companies.

She decided to save money and have her friend do it.

He dropped the tree wrong, and hit our house and one of our trees.

Now it�s a big argument over who is going to pay, her or the friend who cut the tree.

He is saying that it didn't hit the house. I have pictures that I think make the case very clear.

It looks like the only way I am going to get my house fixed is to go to court. Can/should I do this in small claims court ? How much does a lawyer usualy want to handle this ?

And how do you figure out what damages are ? So far the people I have talked to say the whole side of the house has to be re-sided, but they can't match the current siding, so that is going to lower the valume of my house. How much is a tree worth ??

You'll need to know what your damages are before you know if it can be filed in small claims/magistrate court. Cost of repair - and putting you back in the same position - is the place to start. The only way to know how much a lawyer would charge is to have one (or more) review the case.
