Legal Question in Real Estate Law in Georgia

A neighbor's tree fell over and damaged my fence during a hurricane. The neighbor is refusing to fix the fence even though our family members have removed most of the tree - the neighbor helped a fraction of the time by cutting the larger limbs, but since has decided he will do no more and would rather fight in court for the fence repairs. Who is liable for clean up and fence repairs since a perfectly healthy tree came down and destroyed the fence during "an Act of God"?
