my neighbors tree fell on my house but they dont live there and the tree was a dead pine tree can they be reliable

I suspect you mean can they be liable?

Maybe, maybe not. But why would you put yourself through years of uncertainty and massive legal expense when you have such an easy and free answer?

You call your own insurer, who will quickly fix things, and, if there is a strong collectable claim, they will later pursue the other party.
