Legal Question in Real Estate Law in Georgia

Noisey Neighbors

Since moving in our apt 4/99 we have had to call the police numerious times due to the loud music and noise from upstairs. I have called the manager of the apts and requested something be done.I requested when we moved in ,due to my disabiltiies,I am 100% disabled, not to be put under noisy neighbors with kids and dog. The apts manager assured me they would not. They have 2 kids and 3 dogs.

I have complained to managers since the day we moved in to no avail. They keep telling me that the people are moving but it has been a year now. They keep us awake at night and wake us up by 5am nearly everday. It sounds like elephants dancing to hip hop music. My lease is up in april and I can not afford to move at this time. And to go on a month to month lease is an extra $50.What recoures do I have if any?

You do not have much recouse under Georgia law. The situation you pose does not rise to the level of constructive eviction. It count for a reduction in rent (legally), but pardon the cliche, don't count on it.

Under Georgia law, you can either move or get ear plugs.
