Legal Question in Real Estate Law in Georgia
Hello,
We are the original owners of a house that was built in Dec. 2007. The house sits right next to a retention pond, that has settling and erosion issues, since day one. With all the rain lately, the pond seems to have been compromised, and soil and water have started to push back toward our house rather than away from it; thus causing significant settling and cracking in the foundation. The homeowners insurance doesn't cover this, but according to the warranty, the builder does for up to 10 years. Howver, the builder is no longer in business. What do we do?

A warranty is only as good as who issues it, so unfortunately if the builder is out of business the warranty is worthless.
