So are you saying that the condo would be equally divided between all of mother's surviving relatives (son, daughter, husband) since she didn't have a will? What about squatter's rights? Son has been living in the condo for 6 years, 3 of which were after mother's death. He has been paying mortgage, property tax and maintenance expenses. Doesn't that qualify him as the default owner?

Please send me your original posting as well as my reply. I respond to 5-10 postings a day and can't remember the details of all. I thought I remembered from your posting that it was only you and your brother in the picture. Living in the place for less than seven years doesn't give rise to adverse possession (squatters rights). This is the type of case that doesn't lend itself to back-and-forth emails.
