Legal Question in Real Estate Law in Georgia
Both of my parents are decease. They left a house to nine children. One of my sisters contacted me to let me know that the family wants to sell the house. I had mention that I might would be interested in purchasing it along with my husband if none of the other members wants to do it. I am told no one else is financially able to do it. One of my siblings is not communicating with the family. How should I go about this if I decide to purchase the home? Do I need to ensure that all of my siblings are in agreement, including the sister who has pulled away? I do not want anyone to think I am taking something away from them once I have paid for it?

No one can do anything with the home until there is a probate, and in most probates the home would be sold and divided after paying creditors. In some one heir might be the buyer. But regardless, you can't proceed without all the owners, so having one uncooperative sibling is a big roadblock. The answer also depends on if the probate is or isn't complete and other factors we don't know, so your best bet is to sit down with a lawyer, share the needed details and then formulate a plan. Depending on the facts, a court may help divide the property and determine how and if that will happen.
