Legal Question in Real Estate Law in Georgia

Planting trees on property line

I have a neighbor who is a total ***. He has now planted around 20 black walnut trees, a dozen or so oaks and who knows what the others are. The problem I have with the trees are that he planted them with in 3 feet of the property line. Not only will this be a problem as far as maintenance goes (black walnuts) but also the water line to my house is within 6 feet of alot of those trees.

What should I do now to avoid the problems the the future holds? I have to tread lightly around this guy for he isn't all together. We've been in court many times all ready for different things. The guy's just a royal pain.

He has the right to plant the trees, but you have the right to trim both branches and roots back to your property line, to protect your property, and particularly your water line.

Other than informing him that you will take action to preserve your property, and hoping this will produce some sort of compromise, there isn't much you can do at this point.

He can do most anything he wants on his property. However, if it is the case that the trees may encroach or cause damage to your property, that is another matter. Consult with a local attorney about the possibility of getting a restraining order.
