Legal Question in Real Estate Law in Georgia
Hi there! I'd like to know at which point, if ever, someone else's personal property legally becomes mine if left in my home.
Here's some background: A contractor kept his tools in my home during a job. He said if he didn't complete the job by a certain date I would get my deposit money back. He did not complete the job by the deadline. I told him over the phone that he was fired, and asked to meet so he could retrieve his tools and I could get my money back. I have not seen or heard from him since.
His tools are taking up space and I'd like to give them to someone who will put them to good use. I just need to know if I have the right, or when I would have the right, to give these tools away. I live in City of Atlanta, DeKalb County.

If you do something with them absent a court order, you have committed a crime. There are some laws that would address this with a court proceeding, and what you might do is what you didn't ask, and that's sue him for the money.
