Legal Question in Real Estate Law in Georgia

Can I Post a Sign Saying I am Unhappy With Builder and Realtor?

I bought a brand new townhome at the end of May. Since clsing on the home, we have had numerous things go wrong inlcuding a leak from the air conditioner that caused mold on the wall. We have also had other problems that were supposed to be fixed by the builder, per our closing contract but have not been. The builder has now gone out of business, filed bankruptcy, and left the state. I have tried to work with the real estate agent who is developing the area we live in and is currently selling the homes in our nieghborhood that the same builder built. I was hoping that he would help us get these things fixed but he refuses to help. I have taken the action of putting a sign in my car window and our front living room window (which faces the street) reading ''We are unhappy with our builder, who has since gone out of business. We are unhappy with the real estate agent, David Pace, who is selling these homes.'' The agent is threatening to sue us for slander. And that it's detering potential home buyers away when they see these signs. Can he do that? Do we not have the right to have these signs on our private property stating that we are unhappy with how we are being treated? Can't we keep the sign up as long as it's the truth?

The builder is out of business and gone, so how does putting up signs help you or hurt the builder. Further, what does the agent have to do with it? His job (presumably) is to sell homes, not build or guarantee them, so what do you expect from him? If he lied or actually did something wrong in his capacity as agent (which you didn't mention), you would have a pont, but all you mention is your idea that somehow he is responsible for the builder. You may consider what happens to homes in a depressed community - property values go down further. Since no one has incentive to help, you are likely only hurting yourself and your neighbors.
