Legal Question in Real Estate Law in Georgia

Prior eviction??

My husband has recived military orders transferring us to Georgia soon. There is almost no on-base housing where we are going. We have only rented once before, and we ended up with an eviction because my husband did not get paid for three months. We gave the money to an attorney to satisfy the judgement against us, but we recently found out it was never given to the property management company. Needless to say, our credit isn't great to begin with, we have an eviction 3 years ago, and that eviction is an unsatisfied judgement. I understand that no one wants to rent to people with our histories, but we have to live somewhere. How do we go about finding a place to rent? Any help is greatly apreciated.

I'm only going to suppliment Lyle. When you get to your new base there will be temporary military housing, Navy Lodges, etc. There will also be a housing office that will put your name on the list for military quarters. In addition there will be an office with a government employee (Civil Servant) that has lists of rental units in the area around the base that are soliciting military tenants. I went to air intercept school at a Navy Base in Georgia, and rented a small house on Saint Simons Island for a couple of months. In my 22 years of moving around in the military. I doubt I was ever checked once for my credit rating by a landlord. Many times military personnel buy houses in the vicinty of the base to occupy. And then rent them to other military personnel when they are transferred. I would not lose any sleep over the problem. It's just another hardship you'll overcome with the help of the family assistance provided by the military services. With all the help that's there waiting to assist you. It'll just be another adventure for you and the kids to talk about in the years to come.

First, my comments run to the $ paid to lawyer. If you paid money to a lawyer to apply to a judgment and he or she did not apply the money as indicated, it is an OFFENSE that carries the penalty of DISBARMENT in Georgia. You should pursue it. As for the housing issue, I have in the past represented a number of apt complexes etc. Good written references, a security deposit and two months rent in cash (or money order) covers many past rental sins. You should contact the attorney reggarding the payment of the judgment. If this incident occurred in California and the attorney does not immediately pay the judgment, contact the state bar association and they will assist you in getting the judgment paid.
