Legal Question in Real Estate Law in Georgia
I am in the process of short-selling my home. I purchased the home prior to getting married.
Therefore my wife's name is not on the loan agreement or the deed for the home.
My wife's parents (who are Chinese and live in China) want to loan my wife the money to purchase a different home, so that they know their daughter and grandson have a place to live.
My concern is whether my current mortgage lender would in any way be able to attach a lien or in any way make a claim to the new home that my wife wants to buy.
My name will not appear on the new home and the funds that my in-laws provide for this purchase will not be deposited into a bank account that my name is on.
