How Do I Get My Property Back

I was a roommate with someone and she changed the locks one day and would not let me back in,there was no warning and I did not, in my opinion, owe her any money, the rent was paid. She refused to let me in to take my belongings. I have waited for her to take me to court and she hasn't but I want my belongings back. There is over $5000 worth of furniture etc. there so I am over the limit of small claims. Do I have to take her to court or can I turn up with a sheriff to recover my things? It has been a year since this happened and I have contacted her but she won't return my calls.

Well that "eviction" may be a tort, however, I only have the facts that you posted. The limit in small claims court has been raised to $15,000.00, so if you want to pursue an issue at law (no equity there -- remember that), then you could sue her in Small Claims Court. The sheriff may indicte to you that it is a civil matter -- which is sounds like it is (its not urgent since you waited a year), so you should sue her instead of involve the sheriff. HCW
