Legal Question in Real Estate Law in Georgia

On my property is a common well servicing several ajacent homes. The homeowners association used to service the well but gave the rights and maintenance responsibility to a commercial organization who charge the homeowners an annual fee. My covenant makes no mention of these wells. If I was to have a new well dug do I have the right to require the common well to be removed from my property.
