What happens to property when someone dies

My brother recently died without a will. His name was on his mortgage along with my mother. He is survived by a wife and (2) sons (ages 13 and 25). He lived in Georgia. Does my mother now own the property alone or with his survivors?

A mortgage determines obligation, but not ownership. It is possible that your mother does not own the property at all. The initial fees that will begin finding the answer to your question are fairly modest. You may want to contact an attorney to assist you.
