Legal Question in Real Estate Law in Georgia
property easment
I am a home owner with a 1/2 acre lot. I have a dirt road and power lines behind my property. The county is planning to widen and pave the dirt road with a 30 foot right of way. The power lines run along side the road on my property side of the road. The local power co. wants me and my neighbors to sign a request for a 15 foot easment our my property to relocate the power lines 2 feet past our property lines plus a 13 foot easment to maintain the lines. I live in a subdivision with all burried utilities except the lines to the rear of my property. Do I have any write to say no to the easment, and if so what leagally can I do to prevent it . If we cant say no, do we have any rights to reinbursment from the county or power co.

Re: property easment
Since I represent the power company, I suppose I should not respond. Go see a local lawyer. However, keep in mind that in the United States, unless you are forced to sign something (speaking of matters in a civil case such as land), you don't have to sign anything voluntarily that you don't want to. A local real estate attorney in your county should be able to guide you through this relatively easy matter. Hugh C. Wood
