Property line

What can I do if someone puts a fence up down the property line and comes over on our property?

Discuss with them the correct property line, and request they move the fence to the line. Avoid a larger neighbor dispute, which usually do not turn out well.

The situation depends to some extent on your relationship with the neighbor and whether the fence was erected on your property by accident. In any event, if your neighbor is not willing to relocate the fence off of your property, you need to seek legal assistance, unless your property ownership is not important to you. I will add that merely having a fence over your property line does not divest you of ownership of the property. That would not be an issue for a long, long time (many years), if ever. It is certainly not an issue when both parties agree where the line is. The best solution, by far, is to resolve the situation without involving lawyers. You can get a long way with a conversation, and the first letter from a lawyer changes the tone very quickly.
