Legal Question in Real Estate Law in Georgia

protecting the buyer in offering to purchase foreclosed real estate

I wish to protect my right to resend an offer to purchase residential real estate in foreclosure if the property is unacceptable due to inspection or unclean title. The actual purchase will be as is, but the offer can be made subject to requirements. To fully protect my rights to resend, how is it best to word the ''subject to'' info regarding inspection and title search? Thank you.

How best to do it depends on many facts and issues. You really need a lawyer you can discuss this with, and who will draft very specifi language. You either have a binding, written contract for the sale of real property, or you do not. It is "as is," or with conditions. An "offer" with conditions is likely no offer (or contract) at all.

This can be handled in several ways. However, you need to sit down with a local attorney to discuss the variables.
