Legal Question in Real Estate Law in Georgia

If I purchased a home which appears to have a well on the property that was not disclosed in the paperwork, is there anything I can do? The builder has repared the hole 6 times and refuses to take responsibilty now. The county came out to inspect and let us know it is definately an old abandoned well. The hole is now down about 4-5 feet. Would it be worth the trouble to take this to court?

It primarily depends on whether the well was a latent defect that a reasonable buyer could not discover. If so, you may have a claim for fraud. Speak to a local real estate attorney.
