Quit Claim

I quit claimed my house to my brother, who was supposed to get financing and buy it. He never got the finanacing and now he has moved out of the house. He hasn't made a mortgage payment in two months, or paid any utility bills in three months.

Am I still responsible for making the mortgage payments? It's still in my name.

Am I required to give him a 1099 for tax purposes? He made the mortgage payments for 10 months, but he is no longer living on the property.

Title and mortgage liability are two separate things. Unless your loan was paid off, you are still liable. The bank also may be able to call the entire loan immediately, since most notes and security deeds have a "Due on Sale" provision. I suggest getting the title back ASAP. Good luck
