The scenario that you described can be filled with unpleasant surprises and problems for either or both parties in the event that you are trying to handle the details yourself. Therefore, which ever party that you may happen to be, I strongly suggest that you involve a real estate attorney to create documents that will help minimize the dissatisfaction and risk of loss for of both parties during and after the sale.
