my x boyfried of 10 yrs and father of my 1 yr old son and i purchased a home 1 year ago. He made a decision that he was unhappy in the relationship and wanted me to move out due to him making mortage payment and i wouldnt be able to cover the mortage. he also wants to move his girl friend from NC in. My name is on this house and i dont agree with another woman in my home, his credit is not good and he cant refinance,due to being deliquent on the mortgage once and credit cards,and he is not willing to sell. he feels im trying to see him down,and not have the house, however i feel if its over it needs to be over completly. i dont want to be vindictive, i just want to do it the right way.

If no agreement can be reached, you have the right to apply to a court to compel partition of the property. The property will be sold and the proceeds divided.

This is a complicated procedure, and you will need the assistance of an attorney to carry it out.
