rental deposit

My landlord is holding onto my deposit because he said the rental house smells like smoke. He mentioned that he might have to change the carpet if cleaning it doesnt remove the odor. Does he have the right to charge me damages because of smoke odor. There was nothing in the lease or any verbal contract that I could not smoke in house. He is a scammer just trying to find a way to keep my deposit.

The mere fact that you are allowed to smoke certainly does not relieve you of responsibility of the damage caused by the amoking. The landlord is certainly not a scammer because he expects you to take responsibility for any damages you caused by your actions.
