Legal Question in Real Estate Law in Georgia

Rental Repairs

We are renting. We signed a lease/purchase aggreement. We had to do some repairs and other things that were supposed to be done by the landlord. He gave us verbal approval to do these and told us he would just work it out of the rent. When it came time to pay the rent, he denied ever saying he would work it out of rent so we had to eat $300 that we had budgeted as rent money. We paid the entire months rent but would like to know how to go about getting reimbursed or are we just SOL?

Any response we give is subject to the terms on our website.

Well, the contract of repairs with your landlord is as good as the paper it is written on. You said that you signed a L/P agreement. If you only lease and then leave, you may simply be out. If you eventually buy, you may be able to get the $ at closing. The law is murky here because it is really your word against his. If the lease has a merger clause and a no amendment clause unless reduced to writing and signed, the Judge should rule against you because it is not in writing. However, in the world of a $300 rent reduction, you ability to get this one at closing or out of the SD when you move out will depend more on your skills as a negotiator than the letter of the law.
