Legal Question in Real Estate Law in Georgia
We have been renting a house in Georgia for the past 5 years and have been responsible for the lawn care. Just this last spring our neighbor has taken it upon himself to start cutting a section of our yard and out by the road where the mailbox is at.
I have asked them very nicely to not do this because he is cutting it so short it is killing the grass, especially by the road where there is also a deep ditch.
My husband has worked hard to make sure the grass doesn't die by the ditch, because of erosion. Well, even after asking, he has still continued to do so when my husband is not at home. We finally purchased a no trespassing sign, to which we got the response that the portion by the road is not ours and he WILL continue to cut that.
Do I have a legal right to post a no trespassing sign on this portion of the yard and even call the law on them if they continue?
I spoke to landlord the other day and found out where the property lines lay and a portion of their driveway is on his land, however he has never done anything about it. Our landlord even stated that he saw actually nothing wrong with the way we kept the yard. The neighbor even took it upon himself to cut a bunch of wild shrubs that was on 'our' property last year without asking permission from either us or our landlord.
Sure hope you can help. I hate to be a bad neighbor, but we do take care of our yard and he hasn't any reason to be doing any of this stuff.
Thank You

Since the neighbor is ignoring you and is committing a crime, call the police. After one warning, you can have the neighbor arrested for criminal trespass. Be aware that this will mean a feud with your neighbor. But it will stop him.
