Legal Question in Real Estate Law in Georgia

Repayment of Mortgage Insurance payout

I worked and owned a house in Georgia. During a divorce, I had to refinance my house. To do this, I had to have a first and second mortgage because of a lack of funds for the down payment and mortgage fees. After about a year, I lost my job. At the time, I also owned a home in North Carolina. I chose to move home to NC and begin my job search there. It took about 8 months to find a job and I had to make financial decisions and I chose to pay for the house in NC and my house in GA went to foreclosure. After foreclosure, the mortgage company had the mortgage insurance company pay off the 2nd mortgage. Now the Mortgage Insurance company has contacted me and insist that I repay the amount they paid to the mortgage company. They have said they will garnish my wages, if necessary. Do I have to repay this amount and can they garnish my wages? The mortgage company is reselling my house for the full amount of the 1st and 2nd mortgage, but have already been paid the amount of the 2nd mortgage.

Your question is too complicated to answer in this type of forum. You should consult with a local attorney.
