sale of illegal parcel of land

Is there anything to keep you from selling an illegal parcel of land? Land is zoned for 5 acre minimum but parcel being sold has been divided to 3 acres. House is on the 3 acres. As long as buyer and seller know is illegal parcel is sale ok? Zoning will not give building permits without correct zoning but other than that is it necessary to rezone before selling? Property is potential commercial so buyers want to wait to rezone until commercial is there.

Based on your post and the way the issue is stated, it would be very short-sighted of both parties if they each did not have counsel to review all details. Commercial property means bigger lawsuit later.
