In the sale and purchase of a home Is the misrepresentation of a material fact by the seller's agent, which subsequently negatively affects the value of the buyer's property, a felony or misdemeanor in which case it would not be subject to binding arbitration but subject to the court jurisdiction?

It's a civil dispute, not a crime, absent highly unusual facts. Since you didn't say what the misrepresentation was, how it affected value, and whether with due diligence you could have discovered it, a more detailed answer is impossible.
