Septic Failure New Home Fraud By Soil Scientist Aledged

I closed on my brand new (spec)home in April of 1998.In July 1999, my Septic system failed. I had the tank pumped and it failed again December 1999.

I hired a soil scientist who told me my soil was bad! (Gray Soil). There is no place on my 1/2 acre

lot to replace the system because the soil is bad everywhere. I believe the soil scientist who was hired by probably the developer never really tested the soil. Basically I have a $300,000 house that isn't worth a nickel. What should I do?

Do I have any rights? Am I just screwed?

You may have a real fraud case. However, these cases almost always turn first on what is disclosed in the documents, then on the parol statements of the parties. I have about 3 or 4 similiar cases to this in presently in court.
