Legal Question in Real Estate Law in Georgia

I signed a Lease Purchase agreement in March of this year and it states I have until March 2011 to obtain a loan for a mortgage. I also gave the realtor $9000.00 as agreed for down payment, first and last months rent. But yesterday he calls to tell me the owner of the house has let the house go into foreclosure. He tells me I have until the end of October to move out. he is offering me another rental at $100.00 more than I am paying now and it is a smaller house. Am I entitled to a refund of the monies I have paid him due to his breach of contract? What are my rights?

You failed to state the terms of the contract you have with the realtor, much less how the contract was breached. Did you sign a contract with the realtor or the owner? Who got the money? If the contract was with the owner, what agreement do you have with the realtor making him responsible for the foreclosure?

Possibly, but it depends on the exact terms of the agreement. You most likely have a breach of contract claim against the owner, but you will need to have the agreement reviewed before you can be sure.
