Legal Question in Real Estate Law in Georgia

Sold our house 5 months ago"'as is" and buyer waived home inspection during due diligence period. Buyer send us certified letter saying we did not disclose a leak in a front window. We never experienced a leak in that area thus did not disclose it. Now buyer wants us to pay for window damage and floor repair. Are we liable after 5 months of heavy rains in the state of GA? And buyer buying "as is?"

Accepting your version of the facts, the owner would not generally be liable. However, the paperwork is key. Perhaps the new owner is just trying to see if the letter works, and won't really push it.

There is no way to answer without seeing the sales contract and closing papers. If you did the sale properly you hired your own lawyer (not the closing lawyer and not the broker) to either draft or review both. You should call that lawyer to discuss your response.
