Legal Question in Real Estate Law in Georgia
We sold one of two houses in November 2010. Both mortgages were owned by Suntrust. A few weeks before closing we were leaving on a cruise and our realtor told us she needed the loan number for the closing attorney's office. Since we were on the ship my husband called Suntrust and they gave him the loan number. When we got back from our trip we closed. At the beginning of the year my husband discovered the bank gave us the loan number from the wrong house so the wrong mortgage has been paid off and we're still paying mortgage on a house we don't even own anymore. Not to mention the issues with the wrong amount paid to us at closing, inability to file taxes due to incorrect interest paperwork from Suntrust, etc. Plus we're paying an extra $500 a month due to the mortgage on the house we sold being that much more than the other one. It's almost March and the situation still hasn't been fixed. Suntrust won't talk to us and the closing attorney's office says Suntrust is handling it. What can we do???

If you have a dead end, you need a lawyer. It is not something resolved on an internet forum. The bank or closing attorney should certainly take all steps to remedy any errors, but it is surprrsing that no one caught the error when the loan numbers are typically on every statement and document related to the loan. Everyone (including you) should have checked all the information. I trust that no on relied on a phone call made while on vacation (or any other call).
