Legal Question in Real Estate Law in Georgia

Stay-at-home mom/wife not on mortgage

My husband and I recently bought a new home, however, I am not on the mortgage or the title. If we were to divorce, what rights do I have to the value of the home?

The fact that you are not on the title or mortgage does not necessarily mean anything. Consult with a local attorney. If you contributed to the purchase price, e.g., or even if you did not, you still may have a claim to the property.

The court would conduct an examination to determine what you are entitled to. Moreover, by not placing you on the title, your husband has assured that the property will go through probate in the event of his death.
