Legal Question in Real Estate Law in Georgia
subdivision covenants
In Douglas County, Georgia, is there a law or regulation that addresses for how long subdivision covenants remain in effect? If the procedure for ammending the covenants is followed (as described in the covenants), what else has to be done to make the changes official. Can we determine that the new covenants will remain in effect indefinitely unless the procedure described in the covenants for ammending the covenants is followed again in the future?

The answer to your questions is to simply hire a qualified lawyer to make any changes or corrections so that they are correct and enforceable. No doubt there are lawyers in DOuglas County who have done a lot of his work, and Atlanta has firms that specialize in HOA work that can do it efficiently and correctly. It is important to have such matters handled properly in the beginning, or the HOA or homeowners may have big problems in the future.
