Legal Question in Real Estate Law in Georgia

Was the Surveyor wrong? What next?

ok so we bought a 20 acre piece of land. The surveyor did a plat in 1971. In 1972 it was purchaced and in the deed it clearly states there is an easement. However in the deeds for the surrounding property's there is no mention of any easement. So what now? So now we have a deed with an easement and nobody wants to let us go through their property. Is it legal to land-lock someone? Shouldn't it be the legal responsibility of the surveyor to have posted the easement in 1971?

Re: Was the Surveyor wrong? What next?

It appears you are asking whether you have a right to get in and out of your property. This is called an easement for ingress and egress.

Check with the lawyer who did the title work when you purchased your property. If you are in the unfortunate circumstance of not having had a lawyer when you purchased, then you should hire an attorney now to search the title and advise you.

The only way to determine your position is to have an attorney check the title at the courthouse.
