Legal Question in Real Estate Law in Georgia

tenent

I moved into rental property that had about 20 bats, 2kinds of squirrels, broken water heater, unpainted walls, broken rails, broken air condition, roaches and a broken garage. I moved fromanother state so I only seen property once before I moved in. I paid deposit and first month rent. I am 30 weeks pregnant. They fix somethings but now they want me to move because they say all I do is complain. I did not pay July rent because I am waiting on them to fix what needs to be fix. What rights do I have and can they put me out? They said I am just renting not buying. I had an $800 alarm system installed and a baby on the way.

Re: tenent

If they are releasing you from your lease obligations (in writing), that might be the best option for you. If you try to stay, with all the problems you listed, you might be deemed to have accepted some of them and have a harder time getting them fixed later. You also generally do not have the right to withhold rent just because you are waiting to have things fixed. There are exceptions, but you do not indicate you have met those exceptions. Failure to pay rent likely means you have breached the lease and they can start eviction proceedings, put it on your credit report and seek damages from you.
