Legal Question in Real Estate Law in Georgia

Terminating a lease with out Penalty do to relocating

I heard that while in college, that in the state of georgia, if ones job moves them 50 miles from there current place of employment, an apartment lease can be terminated with out penalty. Is this True. I may be transfering out of state and I am only 3 months into a 12 month lease. There is an out clause but I will have to forfeit my deposit and one months rent.

You heard wrong. This is absolutely false. If you don't believe me, log on to Findlaw and read the GA statutes under landlord/tenant law. Even if the Ga General Assembly tried to pass such a law, it would run afoul of the constitutional prohabition concerning the impairment of contracts.

If their is any validity to the origin of this statement it is (and I am speculating) that some quasi governmental entity (UGA, Mercer, private housing devoted to the military) has a preprinted contractual clause in the lease concerning a no penalty for early termination. If you find the answer, send it to me.
