Legal Question in Real Estate Law in Georgia

Termites

I bought my house in May of this year. Received a Wood Infestation Report stating all clear. Owner allowed history of termites. Received bill from termite company late June to renew bond. Paid bill. Made mental note to ask questions about the bond I renewed. Forgot to do that. Went to paint a room in November and discovered saggy floor. Further investigation showed floor joist eaten and active termites in the walls eating the studs. I only had a re-treat bond. Called company. They came out and treated the area. Called Dept of Agri. They came out and did report and said treatment was done wrong - termite company has to come back and do it again. That is scheduled. Do I have a case to have them reimburse me for the repairs? I am trying to have a person who can make decisions contact me from the termite company to ask that they do this. Thank you.

Re: Termites

Depending on the terms of your retention of the inspection company, and assuming the termites did not show up after the inspection, you should be able to get reimbursement for any repairs that would not have been necessary had the inspector found the termite problem.
