Legal Question in Real Estate Law in Georgia
Title Transfer
My ex-wife wants to keep our home, which she is refinancing to remove my name from the mortgage. She qualifies for a refinancing in her name only, but not with a ''cash out.'' So she would need to get a home equity loan in order to fund a buyout. I want to make sure I can refrain from signing the title over to her until she buys out my share of the equity.

Re: Title Transfer
Her lender and its closing attorney should be able to coordinate things so that her refi and home equity closing can be done at the same time. You should be included in the closing so that you can be there to sign off on title AFTER her new loan(s) is prepared to close.
