Transfer of Property

Both of my parents are deceasedI am presently living in the home they owned. They left no will. My

siblings are in agreement with

relinguishing their interest and rights to the property to me. What

form do I need to do this? Do I

need consent from children of my

deceased siblings?

Since there was no will to probate, you may need to administer the estate. There is no "form". Consult with a local attorney.

You should obtain the forms that you need and the information about how to have them executed properly from a real estate attorney. Trying to do this yourself may cause expensive problems down the road in the event that do-it-yourself documents are deficient and the individuals who need to sign them are unavailable or unwilling to sign in the future. As a real estate attorney, I have witnessed numerous problems that resulted from failure to obtain legal assistance to effect transfer of property.

It is worth the time and initial expense of having a lawyer handles it. Find a local lawyer who handles this as a primary practice, and not merely one who claims to do real estate, personal injury, and any number of other unrelated areas to get a fee. The best resource is referrals from trusted and knowledgeable friends or local lawyers. A home tied up in an estate is not something to risk.
