Trouble landscaping our sub divison
I live in a subdivision of 80 homes. We have an association, but it is voluntary. Our subdivision also has covenants on record with the state. Our association has been paying for our front entrance to be landscaped. We are having problems with one of the homeowners on the corner lot which our landscaping is on. They are fighting us to landscape that corner. As it looks by law we have a 20 ft easement right on their property and is also known as common property. This is the one and only entrance off of a main road to our homes. They don't want us to landscape it and have harassed our landscapers. As a small subdivision we don't have a lot of money. We use most of our dues for the landscaping. The have brought it upon themsleves now to hire someone that absolutely buthchers the entrance. We were just up there last weekend ''beautifing'' it and as I drove by today they were chopping it up. We would just like to have a nice ''uniform'' entrance. I just need to know if we could possibly take them to small claims court to settle this once and for all and if we even have a case. Thanks for any advice we can possibly get.

You are asking for an opinion regarding writings filed on the real estate records at your county courthouse. A person could not give an answer to your questions without reviewing those records.
