Legal Question in Real Estate Law in Georgia
Warranty Deed
My 77-year old mother mistakenly signed her property deed over to my brother in Sep 2004. She thought she was signing off her bank loan and actually signed over the deed. She has major health problems and insist that she did not intentionally gift the property over to him. The warranty deed is recorded with courts in my brothers name, but there is still a pending lien 2 years after the deed was signed.

Re: Warranty Deed
Your mother may have a case aimed at setting aside the deed based upon mistake. However, this is complicate. Consult with a local attorney.
