Water tank leaked from upstairs condo unit

Owner's water heater ''broke'' upstairs and water ran down into my condo unit directly under it. The owner tells me to use my insurance and will not pay for water damage. Is owner responsible for this?

Yes the owner is responsible. If you can find out who his insurance is, notify them.

People are generally responsible for the damages they (or their property) cause others. Normally, that would include your neighbor and his water heater. The fact that you may have insurance to cover it would not change that, and if your insurer paid they would likely assert a claim against the responsible person.
