Legal Question in Real Estate Law in Georgia

My wife and I puchased property in April 2012. We just were notified now before we were going to sale the property that the property was never legally ours, as a legal deed was found that the same property was sold to another company in Feb. 2011. The problem is the same company that sold us the property is the same company that sold their own affiliate company the property in 2011.

How do we pursue this because the same law firm was used in both closings Feb. 2011, and ours in April 2012. We want to pursue this and make sure we are reimbursed as well as make the correct filings and complaints with the Attorney Generals office as well as the Federal Office as well.

You will have to have a lawyer, who will then review the facts and tell you what it will take to proceed. If you skipped hiring your own lawyer in April, and a title search to see what deeds were recorded, it is a decision that likely will cost you a lot more money.

I gather you made a huge mistake in not hiring your own lawyer for the original sale, and that small cost then will be replaced by a very big cost now in legal fees.

Hopefully you didn't make a second mistake at closing. EVERY buyer ALWAYS should spend a few hundred dollars extra on OWNERS title insurance (not lenders insurance). If you did, and they missed this at closing (and this is how you avoid these things as they run the title), then the title company simply fixes things for you or pays off your claim.

If you made the horrendous mistake of not buying such insurance, you will spend many thousands on a lawyer.
