Legal Question in Real Estate Law in Georgia
witness to a warranty deed
I need to know ,if when a warranty deed is drawed up in a attorneys office, does the witness have to be present to sign the deed or can this witness sign it later on.I have my copy of the warranty deed with no witness signature. The copy at the court house has a witness signature. Is this not fraud? The witness who signed the copy that is at the court house was not present at the attorneys office when the papers was drawed up.What i am wanting to know is..Dont the witness have to sign the paper in front of the notary?

Re: witness to a warranty deed
Yes. The witness has to be present. I don't know whether it is fraud.
