Wrong tax assessment on home purchase paperwork. Seller seeking refund.
We purchased a home last May (2005). The sellers had vacated the house months before we purchased so the closing was done locally with just my husband and I and our lawyer. The seller contacted me today and stated that on the HUD the estimated taxes for 2005 was based on the selling price ($325,000) and not the tax assessed price (which is closer to $200,000) and therefore they had overpaid at closing. She is now telling us that we owe them $409. Could this be true? If so how since it's a signed contact that has been in effect for almost 10 months, this was not our error it was the lawyers error, are we liable? What steps need to be taken?

You may have signed something at closing stating that you agreed to correct errors or that th buyer and seller would agree to re-prorate taxes once the actual tax bill came out. Without seeing everything your signed I cannot say whether the money is owed.

You should review your closing documents with the closing attorney to see if he/she can point you any provision in the docs that cover this question.
