Legal Question in Sexual Harassment in Georgia

employer actions and rights of the accused

The general manager stated that there was a sexual harassment claim against me, and that his lawyers advised him to put me on a leave of absence until an investigation could be completed. He asked for my keys, credit cards, etc. and told me they would be in touch with me in the future, and that I was not to go anywhere near the office in which I worked. My immediate supervisor was as shocked as I was. There had been no one approach me about any bad behavior, no warning that I may have offended anyone. The general manager would not give me any details on anything. I can think of nothing I have said or done to anyone to create a sexual harassment claim. I feel as though I'm being punished.I've had calls that rumors have already started in the company that I have been fired for sexual harassment. I need to know what I should do. Do I have any rights? Should the company be allowed to handle this claim in this fashion? Should I have been warned, or notified that someone was upset by something I did or said. Do I need an attorney present when I am questioned (if I am questioned)? Please help me.

Re: employer actions and rights of the accused

Your company is responsible to handle any accusations in a fair and resonable manner. I would contact an attorney in your area immediately to ensure that your rights are protected. There are many ways that this investigation could hurt your career if you do not have an attorney looking out for your rights. I would ask your friends and relatives for referrals to a few attorneys and than interview each one to determine whom has the most experience in this type of law and who you think is the most trust worthy. Good luck. If you have any questions please feel free to contact my office via email.
