Legal Question in Social Security Law in Georgia
My father is on SSD and for years child support was paid through SSD. Well they caught him working either last year or earlier this year and now SS is saying that my mother has to pay all of it back and we don't get the money anymore. I am currently 17 but will be 18 soon and SS is saying that I will not receive my monthly check while I am still in school. I am a senior in high school this year and my family and I feel that I am entitled to that money. My question is is there any way that we can I guess sue the SS and make sure that I still get the money that I desperately need. And also is there any pro bono lawyers that will handle this type of case.

The sole basis for SSA paying the child's portion of the monthly SSD award to you was that your father was supposed to be disabled and unable to work. It turns out that he was not disabled and was working. Why would you think that SSA should still keep paying you? The child support obligation belongs to your father, not SSA. An attempt to sue SSA for that would be a loser. Your mother needs to sue your father for unpaid child support, not SSA, since apparently he now has an income. The bigger problem is what are you and your mother going to do because SSA wants its money back that was paid to you and her because of SSA being deceived into thinking that your father was disabled. Get a Social Security lawyer immediately for that and a domestic relations lawyer to pursue the child support case against your father (possibly the same lawyer can do both) immediately.
