Legal Question in Social Security Law in Georgia

income +

I am currently receiving disability. I will be coming into some money, about $100K, in the near future from a lawsuit settlement filed against the insurance company that covered the truck driver who hit and killed my mother. Will this affect my benefits, and if so, how?

Re: income +

If you are receiving SSI, then the $100,000 will be a problem as I believe that it will count against your allowed resource limit.

If you are receiving SSDI, I do not believe that your settlement money will impact your eligibility for SSDI payments.

I agree with the previous answer regarding SSA benefits. However if your question relates to private disability insurance payments things can get a little complicated depending on whether or not the policy has a subrogation (aka "right of reimbursement") clause the explanation of which is too lenghty and complicated for this e-mail. If you do have such a problem go to my website, get my phone number and call me. Ron Lowry
