Legal Question in Social Security Law in Georgia

SSI denied

I've been unable to work since October of last yr. In Nov, an orthopedic surgeon stated that I should'nt do anything physical. In June of this yr I had back surgery (bone graft and fusion of lower back s1 -3). I just got a denial letter stating that since I can move my arms and legs, and not blind,I'm not eligble for SSI. All the work I've done involved heavy lifting.I cant even go to therapy 'cause I can't afford the gas.What are my options,and are they correct about the guidelines ? I'm 41 (been working since 18),and have a 13 yr old child of mine living with me.

Unfortunately this is a common tale--a very common tale.The approval rate for Social Security Disability claims at the first stage in Georgia has fallen to 29% as of the latest statistics.Many of these claimants who were turned down are clearly legitimately disabled.I do not believe this is by accident.Ever since the U.S. government started running these huge budget deficits the approval rate has plummeted.Your only recourse is to appeal. Candidly, if you try to appeal without a lawyer your chances of winning are not good. Social Security lawyers generally take these cases on a percentage (25%) of the past due benefits recovered--no fee for future benefits with a cap on attorney fees of $5300.This is set by statute. You don't have to pay attorney fees unless you win and it comes out of the winnings.Don't give up. That's what the b-----ds want you to do. Get a good lawyer and stick it to SSA. Ron Lowry
